RH, That would be nice...to have an accounting of what is really happening here. Are you suggesting that this man, on his own property (170 acres), is able to divert and 'steal' an appreciable amount of water from the watershed and/or tributaries by temporarily impeding its flow 'downhill'? Seriously? Is there a municipality at some lower elevation that is missing a few swimming pools full of water? What harm is being done? I wonder. Once these illegally constructed and maintained impediments to the downhill flow of water are full, what happens? Doesn't run-off resume as before the construction of the impediments? Or has this miscreant devised a means to direct the overflow toward some other recipient? And to what end? Indeed. Many questions remain unanswered. What harm is caused by these reservoirs? For what purpose was the 1925 law regarding "core source" water enacted? Has Mr. Harrington come upon a way to nefariously profit from a temporary diversion of water of which the City of Medford claims statutory ownership? Yes. I'd say there IS more to this story. And I await your astute response.
